Carver Man Faces Hate Crime Charges Following Violent Attack at Kingston Cumberland Farms

KINGSTON MASS — A local man is facing hate crime and felony assault charges after allegedly launching an unprovoked, racially motivated attack against a man at a Kingston gas station early Tuesday morning.

Gary Phillipo II, 46, of Carver, was arrested following the incident at the 41 Main St. Cumberland Farms.

According to Kingston Police, officers responded to reports of a fight in progress at approximately 7:30 a.m. Investigators determined that Phillipo approached a Black man who was using the gas pumps and began shouting racial slurs.

Police stated that Phillipo charged at the victim, initiating a physical altercation. The suspect repeatedly struck and kicked the victim, knocking him to the ground. During the struggle, the victim sustained severe injuries, including a suspected compound bone fracture.

Witnesses at the scene corroborated the victim’s account, describing the suspect as irate and “out of control.” Police noted that Phillipo continued to yell racial slurs in the presence of responding officers. Officer Oxsen placed the suspect under arrest at the scene.

While being processed at the police station, Phillipo complained of injuries and was transported to a local hospital. Authorities reported that his disruptive behavior continued at the medical facility, where he allegedly yelled profanities, made sexualized comments, and directed further racial slurs at hospital staff and police officers.

A subsequent review of the station’s background records revealed that Phillipo has an extensive history of violence. In the days following the arrest, Officer Oxsen recovered surveillance footage from Cumberland Farms that police say further corroborated the victim’s statement regarding the unprovoked nature of the assault.

Phillipo has been formally charged with:

• Assault and battery with a dangerous weapon causing serious bodily injury
• Assault and battery to intimidate resulting in bodily injury (hate crime)
• Disturbing the peace

He was arraigned at the courthouse and ordered held in custody. He is scheduled to return to court next month.

All suspects are presumed innocent until proven guilty in a court of law.
