Jury in Lindsay Clancy Trial Says It Cannot Reach Unanimous Decision

PLYMOUTH, Mass. — Jurors in the Lindsay Clancy murder trial told the judge Tuesday that they have been unable to reach a unanimous decision after several days of deliberations.

Judge William Sullivan instructed the jury to continue deliberating after receiving a note stating that, after many hours of discussion, the panel could not reach a unanimous decision.

The development came during the fourth day of jury deliberations following a trial that lasted nearly six weeks and included testimony from more than 80 witnesses and more than 300 exhibits.

Clancy, 36, is charged with three counts of first-degree murder in connection with the January 2023 deaths of her children, Cora, 5, Dawson, 3, and Callan, 8 months, at the family’s Duxbury home.

There is no dispute that Clancy caused the children’s deaths. The central issue for jurors is whether she should be held criminally responsible for her actions.

Clancy’s defense has argued that she was suffering from severe postpartum psychosis and other mental-health problems at the time of the killings. Her attorney has maintained that she was experiencing a break from reality and was unable to understand the wrongfulness of what she was doing.

Prosecutors have argued that Clancy was criminally responsible and knew what she was doing. The prosecution has pointed to evidence involving her activities and actions shortly before the killings as evidence that she was capable of making deliberate decisions.

The jury previously requested to review evidence including the knife Clancy used in her suicide attempt and prescription medication bottles found in the home.

The fact that jurors have reported being unable to reach a unanimous decision does not mean the trial is over or that Clancy has been acquitted. The judge has ordered the jury to continue deliberating.

If the jury ultimately cannot reach a unanimous verdict, the judge could eventually declare a mistrial, potentially allowing prosecutors to seek a new trial. For now, however, deliberations are continuing.

The case has received widespread attention because of the questions surrounding postpartum mental illness, criminal responsibility and the deaths of three young children.
