Judges Appear Skeptical of Marshfield’s Challenge to MBTA Housing Law

A panel of judges on Tuesday signaled skepticism over a legal challenge brought by the Town of against the state’s MBTA Communities housing law, raising questions about whether the town can successfully block the zoning mandate.

The law, which applies to communities linked to the , requires certain cities and towns to create at least one zoning district where multi-family housing is allowed “as of right.” State leaders say the measure is aimed at increasing housing production and easing the region’s long-standing housing shortage.

Marshfield officials argue the town was improperly classified under the law and that the requirement unfairly places a burden on communities that do not have direct access to rapid transit. Attorneys for the town told the court that the zoning mandate does not properly reflect Marshfield’s transportation connections or development patterns.

During oral arguments, judges pressed Marshfield’s legal team on whether the state exceeded its authority in adopting the rule. Several members of the panel questioned whether the Legislature clearly intended to give state agencies broad power to tie local zoning requirements to regional transportation and housing policy.

State attorneys responded that the law is being applied consistently across all designated communities. They also emphasized that the statute does not require towns to build housing, but instead requires municipalities to establish zoning districts where multi-family development is permitted.

The judges’ questioning suggested that Marshfield may face a difficult path forward in the case.

A final decision has not yet been issued. Town officials said they are closely watching the outcome, noting that the ruling could have significant impacts on local zoning control and future housing development throughout Plymouth County and the South Shore.
